NEW August 1st 2003 Fee Schedule
With the passage of HB 95 on June 20, 2003, the State Legislature doubled all recording fees EFFECTIVE AUGUST 1, 2003.
This additional revenue will be sent to the State of Ohio to fund the Ohio Housing Trust Fund and the State's General Fund.

For the services hereinafter specified the County Recorder shall charge and collect the fees provided to be paid upon the presentation of the respective instruments for record or upon the application for any certified copy of the record as follows:

The fees provided in this section shall be paid upon the presentation of the instruments for record, or upon the application for any certified copy of the record excepting fees and expenses incurred in the filing of United States tax liens, discharges, and releases, the payment for which shall be governed by section 317.09 of the Revised Code.

Under Sec. 317.32 the County Recorder shall charge and collect the following fees:

FEES- "TORRENS" LAW- Sec. 5310.15

Under the law providing for the settlement, registration, transfer and assurance of land titles and to simplify and facilitate transactions in real estate, known as the "Torrens System."

The recorder shall receive the following fees:

Receipt for Fees.

Sec. 325.28. Each probate judge, auditor, treasurer, clerk of courts, sheriff, engineer and recorder, shall charge and collect the fees, costs, percentages, allowances and compensation allowed by law, and shall give to the person making such payment an official receipt.

No Reduction, Remission, etc., of Fees, Costs, etc.

Sec. 325.32. No county officer named in section 325.27 of the Revised Code, shall make any reduction, abatement, or remission of any fees, costs, percentages, penalties, allowances or perquisites of any kind, required to be charged and collected by him.

Disposition of Fees; Statements of Unpaid Fees.

Sec. 325.31. On the first business day of each month, and at the end of his term of office, each officer named in section 325.27 of the Revised Code, shall pay into the county treasury to the credit of the general county fund, on the warrant of the county auditor, all fees, costs, penalties, percentages, allowances, and perquisites collected by his office during the preceding month or part thereof for official services***. None of the officers named in O.R.C. 325.27 shall collect any fees from the county. Each of such officers shall, at the end of each calendar year, make and file a sworn statement with the board of county commissioners of all such fees, costs, penalties, percentages, allowances and perquisites which have been due in his office and unpaid for more than one year prior to the date such statement is required to be made.

Table of Fees to Be Posted in Office.

Sec. 2335.30. Within three months after being duly elected or appointed, each county officer shall make and post in a conspicuous place in his office for the inspection of all persons who have business in the office, a table of the fees to which he is entitled.

Accounts to Be Kept of Sums Charged and Collected.

Sec. 325.30. Each officer named in section 325.27 of the Revised Code shall keep full and regular accounts of all official fees, costs, percentages, penalties, allowances, or other perquisites charged or collected by him, and such accounts shall be records of the offices, shall belong to the county, and shall be transmitted by such officer to his successor in office. At all times, such accounts shall be subject to examination by the board of county commissioners, the judges of the court of common pleas, or any person appointed for that purpose by such judges, by any person authorized to make such examination, or by any other person.

Fees, Costs, and Percentages Shall Be for Use of County.

Sec. 325.27. All the fees, costs, percentages, penalties, allowances, and other perquisites collected or received by law as compensation for services by a county auditor, county treasurer, probate judge, sheriff, clerk of the court of common pleas, county engineer, or county recorder, shall be received and collected for the sole use of the treasury of the county in which such officers are elected, and shall be held accounted for, and paid over as public moneys belonging to such county in the manner provided by sections 325.30 and 325.31 of the Revised Code.

Itemized Bill of Costs Must Be Furnished if Demanded.

Sec. 2335.32. In all cases when demanded by a person liable to pay any fees or costs to an officer, such officer, without charge shall make, sign and deliver to such person, an itemized bill thereof. After such demand, no person shall be compelled to pay such fees or costs until an itmeized bill is so made and delivered, with a receipt for the fees and costs paid.
